Oben has considerable experience in this sector. Director, Steve Billinghurst is Regulatory lead for Digital Isle of Man.  We can advise on licence applications and matters relating to the regulation of crypto currencies, digital assets and blockchain enabled digital finance.  Further we have had considerable experience with regard to the Digital Finance international network and can assist with multi-jurisdictional matters.  The world of crypto currencies and digital assets has for the last three to five years seen exponential growth and growing interest as a new adjacency to traditional finance.   Our experienced personnel have worked with numerous clients in considering the current and potential future regulatory envelope within which their proposed business model would operate.  The focus to date has been primarily aimed at the Isle of Man perspective, but considering the nascent nature of this regulatory framework, the global perspective, the position of the key international jurisdictions and the direction of travel, we believe we are well positioned to advise internationally.

Our work to date has specifically covered Coin Offerings, Security Token Offerings, tokenisation of real estate, vintage cars and other tangible assets, collective investment schemes and stablecoins as well as reviewing whether business plans based upon distributed ledger technology have any touch point with current financial service regulation.  This work has been from both the licence holders‘ perspective of what regulation means to their business and how to successfully adapt to the regulatory requirements and from the regulators’ perspective of how to set new policy to bring digital finance within their scope in a proportionate way.

Steve Billinghurst is the lead director for this service offering and can be contacted on Stephen.billinghurst@oben.im

We have worked with a number of clients to help them understand the international regulatory framework covering the broad new area of ‘Fintech’. Our focus has primarily been with regard to the way regulation can play a pivotal role in establishing a vibrant industry sector, especially offshore.  Through international research, comparative analysis and country specific deep dives, we have provided businesses with a perspective on possible future regulation as well as discussed strategic objectives and propositions with the boards of both financial service and technology based companies. Whilst it is difficult to predict the future accurately, developing strategies and operational plans to address the future digitalisation of financial services and the customer/ user experience is key for their consumption is critical for many incumbents and new entrants to ensure they are competitive in the fast changing environment.
